Unconstitutional

To the editor:

I do not believe in the platform that Barack Obama was elected under. However, I do believe, trust, and am willing to defend the Constitution our founding fathers gave to this nation. As such, I will continue my allegiance to the Constitution and recognize Barack Obama as our next president since he won the majority of the votes in the recent general election.

My greatest concern with Mr. Obama is his seemingly flagrant contempt for the Constitution which he has voiced on many occasions. From what Mr. Obama has stated publicly he believes that the U.S. Constitution was flawed and stained from day one and that it apparently is not deserving of respect or allegiance, let alone obedience. Given the agenda that Mr. Obama has, I do not see it possible for him to achieve it with the Constitution intact. The agenda of Mr. Obama and the U.S. Constitution are two mutually exclusive propositions that cannot coexist together.

I think Mr. Obama realizes this and intends to take steps to try to nullify the Constitution such that it will not be an obstacle to his agenda. If the Constitution needs to be changed, it is to be done by the amendment process that has been defined in it. If the votes do not exist to achieve an amendment as defined in the Constitution, the constitution then is to remain unchanged. Mr. Obama knows that the public support and the votes do not exist to amend the Constitution in the way that he needs in order to achieve his agenda.

As such, it is my fear that he plans on abusing the executive power of the presidency to try to nullify or change the Constitution apart from the amendment process defined in it. Hundreds of thousands of Americans have died through our history to defend and uphold the Constitution to keep it as the foundation of our government and our nation. It is one of my greatest fears that Mr. Obama does not believe that the Constitution is worthy of dying for, either in the past, but especially in the present.

    Rick, your argument would be helped by direct quotes and reliable references where those quotes could be verified. I can't recall Obama saying anything disdainful about the constitution or anything to suggest he would "nullify" it. The man is a constitutional law expert. He will uphold the constitution.

    Obama's first step in upholding the constitution should be to provide his birth certificate to the electors, so they can be assured he is eligible to be president.

    Let's not get argumentative, let's just see his birth certificate.

    To the author: there has been no greater abuse of the Constitution than under President George W. Bush. More of your civil liberties have been eroded in the name of "homeland security" than in any other time in recent history.

    As Benjamin Franklin said, "Those who would give up Essential Liberty to purchase a little Temporary Safety, deserve neither Liberty nor Safety."

    Sen. Obama did say that the constitution was an “imperfect document.” In the same sentence, however, he also said it was a “remarkable document.” As a Palin/McCain supporter, I think that Sen. Obama’s statement was completely accurate and I don’t understand why so many folks were upset about it. The U.S. Constitution is one of the greatest documents written in the history of mankind, but because it was written by human beings it was imperfect. Last time I checked, human beings have never made a perfect anything.

    I think that a lot of the apprehension about President Obama comes from the belief (which I share) that while he may know a great deal about the constitution, he doesn’t respect the constitution. Of course he wouldn’t be the first president to ignore the constitution. Lincoln, Roosevelt and Bush II did it long before President Obama was elected to office.

    Just keep an eye on regulations signed into law. As Obama has stated we have the right to bear arms, but Congress has the right to regulate them. It is going to be more interesting watching his speeches as millions loose their jobs next year and the economy will worsen to a level never experienced by this country. A year from now, there will be a whole different attitude among people regarding this President. I would be more concerned with getting your own house in order right now, before you find yourself without one.

    Anyone who can read can see that the Constitution does not fulfill the principles of the Declaration of Independence. In essence, the document which perpetuates our country has little to do with the document which created and justifies it.

    The Constitution *IS* flawed. This is why it has been amended 27 times, and there is still more that needs to be fixed.

    The Constitution does not grant you and me the right to vote for president or vice president. This flaw has never been fixed by an amendment and probably never will be fixed.

    The Constitution does not guarantee equal rights for anyone. This country attempted to fix this flaw, but failed during my lifetime, and now it affects me personally.

    The Constitution does not enumerate or limit the power of the presidency. It has a loophole called the Executive Order by which presidents have abused power for over 200 years. The current Republican president has abused this power more than all other presidents combined. If you're worried about the incoming president, don't be worried... it's been done many times before and apparently is perfectly legal. This flaw is not likely to be fixed either.

    Although it attempts not to be, the Constitution is too vague when it comes to the separation of federal and state powers. An example where Alaskans are being hurt by this is the "No Child Left Behind Act" which is probably unconstitutional under Amendment IX.

    Although I could, I won't go on so this comment isn't longer than it already is, but I think Mr. Obama has every right to believe the Constitution is flawed, and so should every other American. As long as we continue to not have liberty and equality encoded in the Constitution, it's not really worth getting excited over.

    In the 2000 presidential election, George W. Bush garnered only 47.87 percent of the popular vote, while Al Gore won 48.38 percent. Does this mean that you (a) did not recognize George Bush as our president from January 2001 to January 2005 and (b) ceased your allegiance to the constitution for the duration of his first term?

    Actually Mike, the Constitution is very clear on Federal and State powers. Read the tenth amendment. However the Congress with the help of the Supreme Court have walked all over it.

    the Environmental Protection Agency issued a rule that alters the definition of solid waste under the Resource Conservation and Recovery Act. It effectively exempts about 1.5 million tons of hazardous waste that is recycled from a regulation that required such material to meet strict labeling, transportation and disposal rules.

After the 60-day congressional review, it will go into effect. If the rule is not deemed ‘major,’ it may still undergo review by Congress, but it is not subject to the 60-day wait period.
    In Effect- The rule is implemented.

    I'm a constitutionalist and I think both parties have worked to expand the federal government's powers well beyond the scope allowed in the Constitution. Neither candidate appeared likely to prevent this, so I voted for the person I think would do the best job improving the country, and that was Barack Obama.

    Obama was talking about two racist provisions of the original Constitution. One was the apportionment provision, Article I, section 2, third paragraph, that said states would get credit for three-fifths of "other persons," that is, slaves, even though the slaves were prohibited from voting:

    Representatives and direct Taxes shall be apportioned among the several States which may be included within this Union, according to their respective Numbers, which shall be determined by adding to the whole Number of free Persons, including those bound to Service for a Term of Years, and excluding Indians not taxed, three fifths of all other Persons.

    The other racist provision was the fugitive slave clause, Article IV, section 2, third clause:

    No Person held to Service or Labour in one State, under the Laws thereof, escaping into another, shall, in Consequence of any Law or Regulation therein, be discharged from such Service or Labour, But shall be delivered up on Claim of the Party to whom such Service or Labour may be due.

    Calling the original Constitution an "imperfect document" was an understatement.

    I think it's a little early to be so hard on Pres-elect Obama. None of us really knows what he is going to do and like every president before him he deserves his honeymoon period.

    But almost every president and congress since Lincoln has contravened the Constitution in one way or another and I will be watching the Obama Administration as well as the Pelosi/Reid Congress carefully. Especially in regard to Alaska's rights under the 10th Amendment.

    nope, I still haven't seen any actual PROOF that Obama is some type of "threat", I did enjoy the links that were posted above (the one from a RUMOR website was pretty funny), but still nothing but fearful ASSumptions from frightened people clinging to their "baby blankets".
